I noticed that when the 100 Hour Board answered this question they didn't mention any Bollywood movies. It seems to me that the bad guy frequently gets away with it in Bollywood. But the current crop of 100 Hour Board writers don't seem to be familiar with Bollywood.

Also, the movie Valkyrie. The bad guys win. Rather decisively, I might add.

I think that Dark Knight definitely fits in more ways than one. Besides making the hero fall, hundreds of people die including the supporting actress, and if I remember correctly, the Joker starts to run the crime rings. Not a happy time for Gotham at all.

Really, almost anything defined as a tragedy has some sort of antagonist winning, even if the environment or life in general is the antagonist.

Mmmm no the Joker gets caught at the end. He still gets his way about a lot of things, but "running the crime rings" isn't one of them.

Seems like it could depend on who you define as the "bad guys." For instance, in both the modern Ocean's Eleven and the modern The Italian Job, the thieves get away with the money. Technically, they are the bad guys, and in the originals they didn't get the money.
